You have reached the Privacy Statement for the GradPoint product, a web-based software application offered by NCS Pearson, Inc. (“Pearson”) that provides instructional course content. This website (the “Site”) is made available by Pearson to those schools, school districts, or other educational institutions or organizations (each of which is referred to herein as a “Licensed Organization”) that have licensed the GradPoint product from Pearson, and to the authorized administrators, teachers and students of such Licensed Organizations. At Pearson, we are serious about protecting your privacy, and this privacy statement (the “Privacy Statement”) discloses how we collect, protect, use and share the personal information gathered on this Site.

Your use of this Site is subject to the Terms of Use posted on this Site, which includes this Privacy Statement. The Terms of Use (including this Privacy Statement) or any part thereof may be revised by Pearson from time to time, through an updated posting, and therefore you should check the Terms of Use (including this Privacy Statement) periodically. Revisions are effective upon posting, and your continued use of this Site, after the posting of revisions to the Terms of Use (including this Privacy Statement), will indicate your acceptance of such revisions. COLLECTION OF INFORMATION

You will need a user name and password to log into the GradPoint product. This will generally be assigned to you by an employee of the Licensed Organization that purchased or otherwise obtained access to the GradPoint product from Pearson and provided such access to you. The Licensed Organization (and not Pearson) controls, defines and manages certain information that is input into the Site to associate your user name and password with you, such as your first and last name and, if you are a student using the Site, other information such as your grade level, teacher name and school name, in order to ensure that the Site provides appropriate instructional content to you and to assist the Licensed Organization in tracking your educational progress when using the Site and obtaining reports on your use of the Site.

ACCESS TO THE GRADPOINT PRODUCT

Please note that your Licensed Organization controls and manages your access to this Site through its issuance to you of user names and passwords. Your access to this Site may be terminated at any time by your Licensed Organization. User names and passwords are personal and non-transferable, and must be kept confidential. Pearson strongly recommends that users of the GradPoint product use user names and passwords that are appropriately complex, and change their passwords frequently. We further recommend that users not use their Social Security Number or any other important identifier as a user name or password for this Site or other websites. It is also important that users exit from the GradPoint product at the end of any session.

If you do not agree to the terms of this Privacy Statement or other Terms of Use presented on this Site, or otherwise do not wish to use this Site, please cease using the Site and contact your Licensed Organization about your concerns.

INFORMATION SHARING AND DISCLOSURE

We consider the following to be examples of Personally Identifiable Information (but there may be others): your first and last name, email address, home address, phone number, date of birth, and certain other information, such as a Social Security Number, if it is linked with your Personally Identifiable Information. Pearson may not have access to all of the above-described forms of Personally Identifiable Information about you as a result of your or your Licensed Organization’s use of this Site, but some forms of Personally Identifiable Information may be input by you or your Licensed Organization in order to permit your Licensed Organization to identify you, and/or Pearson may collect some forms of Personally Identifiable Information from you if you voluntarily provide it to us (e.g., we may collect your email address, phone number or other contact information if you contact us through this Site).

Except as specifically stated in this Privacy Statement, our policy is not to share Personally Identifiable Information about you with third parties. We may share this information with affiliates of Pearson involved in assisting us with the development, maintenance and administration of the Site, and other companies and organizations who perform work for us under contract if access to such information is necessary in connection with such work, in which case such other companies and organizations will be bound to maintain the confidentiality of such information. We may also disclose Personally Identifiable Information in the following situations: (a) in response to a subpoena, court order or legal process, to the extent permitted and required by law, or when we otherwise believe in good faith that the law requires such disclosure; (b) to protect user security or the security of other persons, consistent with applicable laws; (c) in connection with a sale, merger, joint venture or other transfer involving some or all of Pearson or the assets of Pearson; or (d) in order to enforce the Site’s Terms of Use. We otherwise exercise commercially reasonable care not to share or disclose the names of users or any other Personally Identifiable Information to third parties, except with the prior approval of the user or the Licensed Organization. We may use and disclose aggregated, non-Personally Identifiable Information about the use of this Site for our business purposes. In addition, your Licensed Organization will have access to information and data about you that is maintained by us in connection with your use of the Site. For example, if you are a student, your Licensed Organization will be able to review information concerning your progress within the GradPoint product. We may also access such information in connection with our support of your Licensed Organization’s use of the GradPoint product. For example, we may access information about your use of the Site in order to respond to support inquiries or other questions directed to us by your Licensed Organization.

SECURITY

The Site may be hosted on Pearson servers or on servers of a third party with which Pearson contracts to provide such services. In either case, any servers maintained to host this Site are located in restricted-access facilities, and any connections to such servers are through secured connections, with firewall protection to prevent unauthorized break-ins. Pearson takes reasonable precautions and employs reasonable security safeguards to protect Personally Identifiable Information from loss, misuse and unauthorized access, disclosure, alteration or destruction.

This Privacy Statement does not extend to anything that is inherent in the operation of the Internet, and therefore beyond the control of the Licensed Organization and Pearson. Unfortunately, no data transmission over the Internet is guaranteed completely secure, given the inherent operation and structure of the Internet. All transmissions through this Site are done at your own risk.

CHILDREN

This Site is intended to be used solely to provide access to the GradPoint product to Licensed Organizations and their authorized users. In the case of minors who are students directed by their Licensed Organization to use the Site, such minors should use the user name and password assigned by their Licensed Organization to obtain access to the GradPoint product and perform the work assigned to them by their instructors in the Licensed Organization. Minors should not contact Pearson for support in connection with the use of this Site or the GradPoint product; minors should direct any questions to their teacher or another representative of their Licensed Organization.

PUBLIC POSTINGS

Users are reminded that any information or content that is voluntarily communicated to other users or is posted, input or uploaded by a user to a public area within the GradPoint product might be collected and used by others. We cannot prevent such uses, and discourage all users from including Personally Identifiable Information, such as their home address or telephone number, in any such information or content.

COOKIES, IP ADDRESSES AND OTHER ANALYTICAL TOOLS

The use of cookies is common in the Internet industry. Cookies are alphanumeric identifiers that we transfer to your computer's hard drive, through your web browser, to enable our systems to recognize your browser. Cookie technology tells the Site non-Personally Identifiable Information, but does identify your computer, browser and Internet specifications. This Site may use cookies to measure traffic patterns, personalize content and control security. This Site does not respond to "Do Not Track" or comparable signals sent by web browsers.

An IP address is a number automatically assigned to your computer by your Internet service provider. This Site may collect IP addresses, the associated URLs, domain types, the browser type used to access the Site, the country, state and telephone area code where the user’s Internet service provider’s servers are located, and the pages of this Site that users viewed during their visit. Collection of IP addresses is generally for system administration purposes, to gather broad demographic information, to monitor the level of activity on the Site and for security reasons. Personally Identifiable Information may be linked to IP addresses to protect the security or integrity of the Site.

In addition to collecting IP addresses and using cookies, this Site may use other commercially available analytical tools to obtain aggregated data (not including any Personally Identifiable Information) regarding usage of the features of this Site and any products or content accessed through this Site, to assist Pearson in providing, maintaining and improving Pearson's products and services and in protecting the rights or property of Pearson, our licensors, or our users.
